Hino Class Action Update - Fact Sheet 1

RETAIL CUSTOMER INFORMATION ACKNOWLEDGMENT

FOR DELIVERY OF VEHICLES

 

It has come to our attention that since around 8 August 2022, Hino dealers have been required by Hino Motor Sales Australia (HMSA) to only deliver Hino vehicles to consumers who sign a Retail Customer information Acknowledgment (“Acknowledgment Form”).

Should you be asked to sign an Acknowledgment Form ensure that the Acknowledgment Form includes the following terms:

 

The rights to which you are entitled under your purchase contract (e.g. warranty and/or guarantee rights) and under the Australian Consumer Law remain unaffected by the information mentioned above and your decision whether or not to take delivery of the vehicle today.

This clause would likely ensure that your rights as a member of any class action are not prejudiced. Thus, signing an Acknowledgment Form with this clause and taking delivery of the vehicle is not likely to prejudice your rights as a member of any Class Action against Hino.
